Debt Solutions Southwest Ltd is a debt management business based in the South West of England, providing a full debt management and credit advisory service to individuals and businesses.

If you have entered into a credit card agreement before 7th April 2007 and have an outstanding balance on your card, the debt could be completely unenforceable because:
- a) The card company or its agent (who is usually a debt collection company) is unable to supply you with a true copy of the original agreement.
- b) The agreement itself is deficient (in other words it does not contain certain provisions - or information - as is now laid down by law). And note, unless the agreement contains all the provisions it will be unenforceable

If your card company has levied illegal, unfair or excessive charges, or penalties or default charges against you at any time during the duration of your agreement, it is likely that you will be able to have these charges removed, thus reducing the amount you owe on the card, or even eliminating the debt completely

Because of the difficulties, both practical and legal, faced by card companies and/or their agents in collecting outstanding credit card debts, the companies are often willing to compromise the debt, that is, to accept in full and final settlement an amount less than the total debt due. Of course, such settlements are usually only achieved by those debtors who know what they are doing and know how to make life difficult for the card companies and/or their agents.

Sometimes, what you really need is some peace and quiet and some time to sort out your affairs without being hassled by lenders. You will get this when you hand over the management of your financial problems to me whilst I negotiate eliminations or settlements with your lenders. This alone could be worth the fee!

You can tackle this task yourself and get assistance from the Financial Services Ombudsman to do so. Or you can engage me to help you.

For an initial fee payable up front, I will show you how to legally get a copy of your agreement and your card statements, which I will review to decide your rights. I will then advise you of the best way forward to decide what action is appropriate. Of course, if the card company cannot produce the agreement (which does happen often!), we will know immediately that your agreement is unenforceable. Alternatively, we might have to establish why the agreement is unenforceable and whether to go for a complete write off, or reach a compromise with the card company or agent to have the debt substantially reduced.
Once I have succeeded in having your debt totally wiped clean or reduced, I will then charge you a success fee based on what I have saved you! The dealings with the lenders can take up to six months depending on how quickly the credit card company responds to our requests for information, etc.
The initial fees are as follows:
- £395.00 for the first card or loan
- £150.00 for each card or loan thereafter
The success fee is 15% (fifteen percent) of all amounts saved through elimination, settlement or compromise of the debts.
